If you’ve been injured due to medical malpractice, you have the right to seek compensation for those injuries.  Medical malpractice cases vary as far as worth for many, many different reasons.  Below, you’ll learn some different factors that determine the value of a medical malpractice case.

1. Injuries Sustained

One of the things a jury will look at is the injury or injuries sustained by the victim.  If the injuries are minor, a small amount may be awarded to take care of medical expenses, pain and suffering.  Of course this will be increased as the severity of the injuries increase.  If the injuries are fatal, permanently disfiguring or disabling, or other seriously severe types of injuries, a major award is typically granted.

3. Medical Bills/Out of Pocket Expenses

Medical bills that are due and any expenses incurred because of the injuries will be figured into the award as well.  If medical bills and more expenses are anticipated, this amount may be estimated and added to the award.  Out of pocket expenses may include medical equipment, changes made to the home in order for it to accommodate the victim after his or her injuries and similar costs.

4. Pain and Suffering

The pain and suffering is difficult to add, because there is no actual price that can be placed upon the pain and suffering of any individual.  However, the severity of the injuries as well as where the injuries occurred will be taken into consideration.

5. Compensation Caps

In some states, there are caps or limits on what a victim can receive because of a medical malpractice case.  If there are pre-determined caps in your state, this will also be taken into consideration.  Often, with severe cases, the victims are granted the maximum amount allowed with the compensation caps in mind.
