Lawyers for medical malpractice offer their services to patients who have suffered negligence or other poor treatment from medical professionals. They seek to win compensatory damages for their clients' economic (out of pocket, medical expenses) and non-economic (pain, disability) sufferings. Many medical malpractice verdicts and settlements result in heavy monetary compensation. One result of this is that insurance companies pass the costs on to their customers. This is generally done in one of two ways: insurance companies raise their premiums, and they offer fewer services, so as to avoid medical malpractice litigation. Because of this, proponents of tort reform argue that there should be a cap on compensatory damages. Others argue for a "loser pays" system, whereby the plaintiffs in a losing case would pay the defendants' lawyer fees if they lose their case. Opponents counter that the current system protects patients from legitimate cases of medical malpractice.
