Medical malpractice laws vary from state to state. This includes a statute of limitations that limits the time a patient has to file suit against a medical professional or facility. The latter case, referred to as vicarious liability, occurs when the medical professionals allegedly at fault is an agent of that hospital. Currently, each state has its own rules and regulations covering medical malpractice compensation. This type of compensation is regarded by some as frivolous, and the subject of discussions revolving around tort reform. Others, however, view it as necessary in helping victims of medical malpractice receive compensation for damages.
