In the ongoing debate over health care reform, certain segments have spoken of a "medical malpractice insurance crisis," whereby malpractice insurance rates have risen drastically. Further, many insurance companies have ceased to offer medical malpractice insurance. Doctors blame the problem on the rising number of medical malpractice suits. Many say that tort reform, which would include a cap on the dollar amount of damages that plaintiffs can receive. Lawyers counter that states which have enacted tort reform have nonetheless seen insurance rates continue to rise. Further, they say tort reform does not address the related issue of medical errors, and that the fear of getting sued for medical malpractice may be greater than the actual risk, and even, medical malpractice insurance pools are insufficient to mitigate risks.
