On one side are the insurance lobbyists who insist that lower caps should be placed on medical malpractice court awards, in an effort to minimize the cost of medical malpractice. On the other hand are the attorneys and their clients who have been seriously injured or have lost loved ones to negligent medical care. This party feels, as many states have found, that caps are unconstitutional.
