Medical negligence lawsuits are filed by victims, or the estate of victims in the case of claims involving death, stating a healthcare professional or any number of other defendants failed to offer a standard of care to a given patient. By breaching this standard of care, the doctors placed a patient at unnecessarily increased risk to injury or complications, which actually caused some form of damages directly attributable to the given breach of duty. Suits filed by patients often entail some form of medical injuries that other physicians had to correct, continued therapy, loss of mobility, lowered quality of life, or some other permanent scarring, which could have all otherwise been avoided by a reasonably practicing healthcare professional.
