Question:

My husband had surgery back in November of last year on his back. Since then he can hardly walk and the falls a lot.  Once when he fell he tore a ligament near his angle. The doctors that he is seeing said that it's from the surgery and that he has nerve root damage in his back and two compressed nerves in his groin (from the nerves being compressed during the surgery).

The have put him in a moffo brace and are about to give him a device that helps him to bend his foot up. He will have to wear this because he has drop foot now.  Every time he goes back to the doctors they keep saying to be patient.  When you ask them how they intend to fix this they say "It's a piece of the puzzle, we just have to see what we can do."

Needless to say my husband is so depressed that he is now seeing a doctor for depression and also he has since lost his job because he could not return to work.  Can a medical malpractice lawyer help us regarding this matter?  We are both at a loss.

My husband use to be so athletic and now, he can hardly walk.  We don't even sleep in the same bed because of the pain that he is in constantly. What can we do? We were not warned of any such risk when we signed the consent form. Can we file a medical malpractice lawsuit against the doctor that performed the surgery? How do we begin to investigate the details of what really went wrong?

Answer:

Depending on the circumstances of the case, you and your husband may be able to file suit against the surgeon for negligence medical care. In order to do so, an expert medical witness will investigate the claim to determine exactly how the injury occurred and whether it was the result of medical negligence.

If the expert says that the surgeon was indeed at fault, then you can file a medical malpractice suit for all the medical expenses, pain and suffering, lost income and lost future earnings.

The best option is to talk to a medical malpractice lawyer about your case. Most of these specialized attorneys have a medical doctor on staff or nearby who can investigate on your behalf and find out if you have a good case.
