An overdose of chemotherapy caused serious heart problems in my daughter. Can we sue this doctor?

Question:

The doctor in the oncology department did not write down the orders for my daughters first chemotherapy session.  When the nurse called to get the instructions the doctor told her to give my daughter all three medicines in her 1st chemo treatment. (He was supposed to order 2 medicines to be given for six weeks and the 3rd medicine the next six weeks).

At My daughters next appointment she advised them she has been so sick and already her hair had started to fall out.  When doctor looked at records she said oh, no that is far too much toxin. She should have only given the two medicines for six weeks and 3rd medicine next six weeks.  He tried to blame the nurse for making the error but my daughter and son-in-law heard the doctor on the speaker phone give the order to give her all three medicines at her first treatment. 

Now she is having problems with her heart and the doctors think it was damaged with this overdose of chemicals.  We have to go soon and have a consult about a heart cath since her heart rate goes up to 230 and stays there until she gets to emergency room to get medicine to correct this.  She is only 36 yrs old.

Can the doctor be held accountable for causing me daughter potentially permanent heart problems? Clearly, there was an overdose of chemicals which seriously damaged my daughter’s heart.

Is this medical malpractice? Can we sue the doctor for failing to give the correct instructions?
