Question:

My mother was 62 years old and generally in good health. She underwent total hip replacement and there was a complication the following day. A clot went to her lung. This clot was found and remedied. She was released to a care facility in Delaware. On any given night she asked to go to the ladies room, when I went to nurses station, there was nobody around. her nurses call button was activated. Fianlly when I found someone and they said they would be right there. After arriving home that evening I called her and asked if someone came..."not yet" it took me over 1 hour to get home.

Meals were not brought to my mother and it was obvious to myself and my brother that there was something wrong, because my mom seemed to be very confused and almost delerious at times. Upon asking the nurses we were told it was fine. After two weeks my mom was transfered to another Hospital due to critically low sodium level. Two days later she passed away. Cause of death is listed as Bradycardia.

I am convinced that negligent medical care was the cause of her death. Can we file a medical malpractice lawsuit in this case?

Answer:

This is a complicated case that will require a thorough investigation by a medical expert. The only way to get advice in this case is to schedule a consultation with a medical malpractice lawyer.

Ultimately, you and your attorney will need to prove that the hospital, doctors and/or nurses failed to perform their duties to the required level of care, and that this negligent treatment was the direct cause of your mothers death.

Good luck.
