Question:

I went to a doctor where I was given an ultrasound and was told that I was having a miscarriage so they then advised that I have an abortion to remove the dead fetus. I was told that the baby would no longer grow so the abortion was the safest thing to do. The following week I went to a clinic where they gave me a normal aspiration abortion and i was sent home. Four days later I went to the ER in extreme pain, and I was given a sonogram and was told that not only was I still pregnant, but the baby was alive and living outside of my womb. I was already bleeding internally and I had to have surgery were the baby and one of my fallopian tubes was removed. Is this a case of medical malpractice?

Answer: (1)

That is a terrible story, however it's unclear if there was any negligence in the medical treatment by the hospital. It is likely that there is some element of inadequate medical treatment, but you will need to talk to a medical malpractice lawyer to find out if the details of the treatment and resulting injury warrant seeking a medical malpractice lawsuit.
