My husband died from a staph infection after surgery. Is this a case of medical malpractice?

My husband went in for a surgical procedure, and was doing ok afterwards. But after about a day in the hospital he began to get worse very quickly. The doctors looked at his symptoms and thought that he was having adverse reactions to the anesthesia. After about 8 hours his condition deteriorated and at that point it was found out that he had acquired an infection during surgery.

The doctor began administering antibiotics but it was too late. He dies shortly later from heart failure and the hospital staff was unable to revive him.

What are my options in this case? In this medical negligence. Can I sue the hospital for medical malpractice and the loss of my husband?

Infection is a very serious concern in a hospital setting, and especially so in a surgical setting and ICU. An infection is normally caught early and treated with antibiotics, however, if it is allowed to spread, or worse, enter the bloodstream the consequences can be deadly.

Hospital acquired infection such as this are not an uncommon occurence in hospital and clinical settings, and medical staff are required to take measure to ensure bacteria are not allowed to cause further harm to patients. If an infection is transferred to a patient during surgery, the catastrophic injury is very high due to the ready access to the patients bloodstream.

If a bacterium is contracted and enters the bloodstream, the infection of internal organs can lead to serious injury or death. If it is found that negligent medical care was the cause of the infection, then the hospital, nurses and/or surgeon may be held liable for the injury and sued for medical malpractice.
