My daughter had to have an emergency appendectomy last month. Since that time, she has suffered with a horrible staph infection that I'm sure she got from the hospital. Is the hospital legally liable for my daughter's infection?

Staph infections are common hospital-acquired infections and usually occur when hospital personnel, including doctors, nurses, technicians and even custodians, are careless about their hygiene. Hospitals require that their staff members wash their hands after using the bathroom and between patients, but unfortunately, too many do not adhere to these standards. Also, staph infections occur when staff members do not sterilize equipment. The newer strains of staph infections are particularly troublesome as many of them are resistant to antibiotics, making them that much harder to treat. If proven that a staph infection has occurred through hospital negligence, then that hospital is legally responsible as hospitals are liable for any preventable harm that occurs to patients in their care.
