Question:

My Father was sick and had been going to the doctor numerous times in the last 2 and a half years. Last year he started getting head aches, dizziness, nausea and he was getting blood work every visit.  He was diagnosed with ear infection. A few days later I took him to the doctor again, and they sent him home.

Three days later I took him to a different hospital, and 20 minutes later they diagnosed him with lung and brain cancer. Treatments started immediately the next morning, but it was too late. He died three months later.

I asked the nurses why wasn't this found sooner and could his life span been saved, and they said they did not know why this was not found and to seek legal advice. So, does this sound like a case that warrants a medical malpractice lawsuit? Can we hold the hospital accountable for undiagnosed cancer?

Answer:

You may have grounds to file a medical malpractice lawsuit, as well as a wrongful death claim. It sounds like the first hospital was given more than adequate opportunity to diagnose your fathers condition, and failed to do so. Given the fact that the second hospital diagnosed the problem so quickly, it seems the first hospital was negligent.

If it can be shown that the hospital was negligent in failing to diagnose the cancer in a timely fashion, then a lawsuit can be filed against them demanding civil compensation for his pain, suffering and untimely death.

Talk to a medical malpractice lawyer now to find out what options you and your family have to get justice in civil court for your fathers situation.

Good Luck.
