Question:

My wife recently had a hysterectomy.  During the surgery, she sustained damage to the colon.  Does this constitute medical malpractice?

Answer:

Before going forward with any surgery, patients should be provided with a list of the possible complications that may arise.  Every doctor should convey to his or her patients that no surgery is without risk.  A serious injury that is caused by a preventable surgical mistake may warrant legal action.

Surgical errors can cause a lifetime of pain, suffering and devastation.  The most common types of surgical errors include:

  • Wrong site surgery
  • Negligently performed surgery
  • Laparoscopic surgical error
  • Unnecessary Surgery

When a surgeon slices the wrong anatomical structure and doesn’t diagnose the error or acknowledge the harm it can cause, surgical negligence has occurred.  Whatever the cause of the error, the surgeon and/or the hospital must be held accountable for the injuries they have caused.

When you are injured because of a surgical error, an experienced medical malpractice attorney can help you obtain financial compensation for your pain and suffering.  They can advise you on how to proceed if you choose to file a medical malpractice lawsuit.
