Question:

My husband died due to complications with anesthesia during bypass surgery. Apparently they ran out of oxygen and he died of oxygen deprovation. Is this medical malpractice?

Answer:

Anesthesia complications can arise in a variety of situations.  Is it the responsibility of the anesthesiologist to check the patient’s record and medical history to ensure that the use of anesthesia is not going to adversely interact with the patient’s current medications or existing medical conditions?

Anesthesia errors can occur for a number of reasons, but are often the result of professional negligence.  Complications from anesthesia can cause long-term coma and brain damage.  Some victims who experience a bad reaction to anesthesia can be left in a persistent vegetative state and even death can occur.  A few of the reasons a healthcare practitioner may be at fault include:

  • Failure to seek informed consent for anesthesia
  • Failure to monitor the patient’s breathing and oxygen levels
  • Administering a medication that the patient is allergic to
  • Communication errors before, during or after the procedure among medical staff and patients

Victims of medical malpractice due to anesthesia errors may be entitled to significant monetary compensation by those responsible.  An experienced medical malpractice attorney may be able to help you in obtaining a settlement and ensuring that the people responsible are held accountable for their actions.
