Some medical malpractice lawsuits make it to court and some will settle outside of court. The attorneys on both sides of a medical malpractice case will assess how money they think is fair to compensate the injured person for his injuries. The attorneys will then assess whether they believe they would get more, or less, of an award if the matter went to trial and a jury had to decide the issue. Some patients are more sympathetic than others and some types of injuries are more upsetting to jurors than others. If the medical provider believes you have a strong case, the medical provider will try even harder to settle the case without going to court. Going to court is always riskier than a settlement because you know what you are getting with a settlement and you never know what a jury will award. Of course, the jury might award much more than the settlement offer, but you won’t know until after the verdict comes in.
