Question:

Can medical negligence be handled in civil court?

Answer:

Medical negligence can and often is handled in civil court. Medical negligence is a form of personal injury law, just like a car accident or a slip and fall case. The primary difference is that, since medical negligence deals with professional malpractice, a different standard is used to determine if the doctor or health care provider was negligent or not.

Medical Negligence in Court

If you believe you were the victim of medical negligence, your first step should be to get a lawyer. Your lawyer can then help you to file the appropriate complaint in court that alleges all of the things you must prove in order to win a medical negligence claim. These things that you must prove to win your case include:

  • That the doctor or health care provider was negligent, as judged based on a reasonable doctor standard (i.e. his level of care fell below what any reasonable doctor would have provided)
  • That the doctor's negligence was the direct or proximate cause of some specific injury that you faced. The more grave your injury, the more you should be able to collect by filing a civil suit, since the damages awarded by a jury will be based on your medical bills, any wages that were lost due to the injury, pain and suffering and any emotional distress that the injury caused you to ensure.

In many cases, once you file suit, the insurance company for the doctor's medical malpractice insurance will offer you a settlement. It will be up to you if you want to accept that settlement or if you want to see what the jury awards you. It is key to make an informed decision on whether to settle or not, so you should not make this decision without first consulting with your lawyer.
