Question:

My gynecologist did not detect abnormalities in my pap smear, and as a result she didn’t detect HPV or pre-cervical cancer changes. When I switched to a new gynecologist, he commented that my old doctor should really have found this. Can a gynecologist be sued for medical negligence?

Answer: (1)

As a physician, a gynecologist can be sued for medical malpractice just as any other doctor can. However, you must prove that your gynecologist fell short of the standard of care that is required. In other words, you must show your doctor did not treat you as a reasonable gynecologist would have.

Proving medical negligence is done by having an expert medical witness, a neutral third party doctor, investigate the case and determine whether the standard of care was met.

You will also have to prove that you suffered damages that you would not have experienced, but for the negligence. Speaking to a licensed medical malpractice attorney about your rights can give you further insight into what you need to do to prove these charges.
