The risk management office of the hospital is trying to offer us free medical care because they made a medical mistake and cost my wife her fallopian tube. We are thinking about bringing a lawsuit to get compensation for her suffering. What happens once a hospital lawsuit is filed? How long will it take?

Answer:

Once a hospital lawsuit is filed, the hospital’s insurance company will usually send its lawyers to investigate the claim against the hospital to determine if there was a negligent act, and if so, who made it.  There will be an investigation to determine if there was a failure of equipment or a failure of communication, or a failure of judgment.  There will also be an investigation into the extent and cause of the patient’s injury, which may include a medical exam and the deposition of the injured patient.  Either the hospital staff or the attorney hired to represent the hospital’s insurance company may meet with the injured patient to offer a settlement.  They may be required to attend arbitration if the hospital required the patient to agree to arbitration before treatment.
