Question:

I went to the emergency room, and was admitted for abdominal pain. After waiting for a few hours I was finally seen, only to be released with pain killers after a few minutes. Well, I went home and took the pain killers, but the pain continued. Finally after a few hours I felt something wrong and was in agonizing pain. I went back to the hospital and it turned out I had a burst appendix.

I was rushed in for surgery and had my appendix removed. Can the emergency room be sued for disregarding my symptoms and releasing me?

Answer:

While the emergency room doctor may be liable for medical negligence, it doesn't sound like you suffered any significant injuries for which to seek compensation. Medical malpractice lawsuits are reserved for those cases where serious injury was sustained due to negligent medical care.

If there is something that you've left out for which damages could be demanded, then talk to a medical malpractice lawyer because there is definitely potential for medical negligence in your case.
