Question:

Can I sue the hospital for an undiagnosed ectopic pregnancy? I went in to the hospital a month ago, early in my pregnancy and I had pain in my stomach and some mild bleeding. Since they didn’t diagnose it, I ended up with loss of the fallopian tube from the pregnancy.

Answer:

From your description of the events, it seems likely you would be able to sue the hospital. Your symptoms are symptoms of an ectopic pregnancy, and when a patient comes in with such symptoms, it is reasonable for the hospital to test adequately. Failure to adequately test you and diagnose the pregnancy may thus be considered medical malpractice. You should consult with an attorney who can get more details about your specific situation to help you determine your best course of action.
