You may have legal recourse for misdiagnosed appendicitis if you suffered an injury from the misdiagnosis. If the patient dies then the family may be able to file a medical malpractice claim as well as one for wrongful death. Understand that not all cases of misdiagnosis result in medical malpractice – if the doctor followed reasonable, acceptable procedure that would have been followed by other similar physicians, there may not be a case of malpractice. There may also be an acceptable margin of error that is a part of any practice of medicine which could negate any lawsuit.
However, cases of a misdiagnosed appendicitis can lead to complications and sometimes death so these cases, if proven, can bring significant damage awards.
