As with other negligence claims regarding symptoms, you must be able to prove negligence by a doctor who missed your heart failure symptoms in order to win a lawsuit. If your heart failure symptoms are noticeable and would be detected by a reasonable doctor during an examination, but your doctor missed them, you might have a claim for a lawsuit. In addition to proving that you had symptoms which should have been detected though, you would also have to prove that the doctor’s failure to detect your symptoms caused you more injury than if he had discovered them. So you would have to prove that he could have prevented the heart failure, or that the result would have been less damaging if he had not been negligent in missing the symptoms.
