Question:

I am 28 years old and found a suspicious lump.  My doctor referred me to a surgeon who misdiagnosed a cancerous breast lump as benign.  He relied on the test results from the mammogram, and did not inform me that it has an error rate up to nearly 30%.  Because of his poor care, I have had to undergo more aggressive forms of treatment for my condition.  Can I file a lawsuit against this doctor?

Answer:

At least 10,000 women each year are misdiagnosed with breast cancer, most of which are young women.  This commonly occurs due to age bias where breast cancer it not expected in a young woman.  As a result, doctors do not performs all the correct tests and aggressive procedures to adequately rule out cancer.  A physician’s misdiagnosis of breast cancer can occur for a variety of different reasons that may include:

  • A lump is discovered but is not picked up during a mammogram test
  • The mammogram or ultrasound test is misread
  • A pathologist misreads the biopsy results
  • The biopsy is not performed correctly
  • A malignant mass is diagnosed as benign

The effects of breast cancer misdiagnosis can be serious and often fatal.  Patients who are misdiagnosed often have to undergo much more drastic forms of treatment, such as higher dosages of radiation and chemotherapy.
