Is a misdiagnosed tubal pregnancy grounds for a malpractice lawsuit?
I went to the doctor after having taken a pregnancy test, hoping to have a child, but the doctor said the test was wrong. I continued to feel sick and have abdominal pains, so I went back. Again, they said I was fine.
Finally, after demanding that I be checked out more thoroughly, I was sent to see a gynecologist who discovered I had a fetus growing in my fallopian tube. I had to have emergency surgery because there was internal hemorrhaging.
As a result of all the mistakes, I lost my fallopian tube and can't ever have a baby. Can I file a lawsuit against the hospital for this terrible treatment?

Answer:
Yes, you may be able to file a lawsuit for the negligent treatment you received. You will need to show that the symptoms for which you were admitted required that you be tested further for possible ectopic pregnancy. This is not an uncommon occurrence, and the hospital should have recognized the potential for this type of pregnancy complication.
You may be able to get substantial compensation for emotional and physical distress, as well as medical and other economic losses. Given the fact that you are now unable to ever have a child, the non-economic damages may be quite large.
Talk to a medical malpractice lawyer about your situation to find out how strong the evidence of your case is, and how much you can expect to demand through a medical malpractice lawsuit.
Good luck.
