Medical Malpractice Cases Drop Sharply

June 10, 2009

Recent studies have shown that the number of medical malpractice cases have dropped dramatically in recent years. This is most likely because lawyers are less willing to take medical malpractice lawsuits, because doctors and hospitals often win the cases when they go to court.

Oftentimes, a lawyer can work with his or her client to have the hospital or doctor settle outside of a courtroom. This generally gets the client a larger sum of money and he or she can avoid the hassles of a lengthy court battle. However, if the doctor or hospital refuses to settle, often the jurors vote on the side of the medical experts.

Part of the drop may also be contributed to the insurance companies, who have done their part to shut down potential plaintiffs, by convincing the public that the verdicts and high-dollar payouts have led to bloated premiums and fewer dollars.
