This means that their mistake, action, lack of action or error is the cause of the injury and that they did not treat you, as the patient, to the best of their ability. This may include not calling in a specialist or knowing their own limitations with regards to handling your health issue.

Element 3: Injury

The mistake, error, misdiagnosis or negligence of the medical professional must have lead to some type of injury to you as the patient. To get to this information your attorney may require that you seek medical services and opinions as well as the attorney speaking with these physicians and providers to gather information for the case.

Evaluation

Once the medical negligence attorney has gathered the required information and has evaluated your case he or she can then provide options for how to proceed. They can also use their experience to help you determine what a reasonable claim would be based on the facts of your case.
