Medical malpractice is negligence that is committed by any healthcare professional, including a gynecologist or a doctor that specializes in obstetrics and gynecology (ob-gyn).  Negligent gynecological treatment might occur when a gynecologist acts in a manner that differs from the normal standard of care that would be given by another healthcare professional with similar training in an equivalent situation.  When a gynecologic medical injury occurs, the patient who has suffered the harm may have grounds to sue a gynecologist for medical malpractice.

Proving Ob-Gyn Medical Malpractice

Ob-gyn medical malpractice occurs when there a gynecologist or other healthcare professional causes harm to a patient by acting so as to deviate from the usual standard of care, given the facts and circumstances surrounding the situation.  You must prove that the gynecologist acted negligently or recklessly in providing you with care that directly caused your injury.  Negligent gynecological treatment is more than a bad result from treatment; typically, there must be a gynecologic medical injury that occurs due to negligent or reckless behavior on behalf of the gynecologist.

Damages in a Medical Malpractice Case

The extent of damages that you might be entitled to if you successfully sue a gynecologist for medical malpractice will vary according to a number of factors, including the type and extent of your injury, the degree of the negligent or reckless behavior of the gynecologist, any caps that your state might place on damages awards in medical malpractice suits, and even your geographic location.  All of these considerations will directly impact a jury as it determines any damages award in your case.  Plus, your damages award will further be reduced by the amount of attorneys’ fees and other litigation expenses that you have incurred throughout your medical malpractice case.
