What are common types of damages in a medical malpractice case?
I am a 52 year old woman with a family history of breast cancer. After feeling a lump in my breast, I went to see my doctor. He failed to diagnose the tumor in my breast, and I learned about it two years later when the cancer had already spread. What types of damages may I recover?

Both economic and non-economic damages may be recovered in a medical malpractice lawsuit. Economic damages consist of compensation for monetary expenses and losses incurred by the patient or that can be reasonably expected to be incurred in the future due to the health care practitioner or provider's negligence.
These include funeral expenses if the injury caused death, loss of earning capacity, lost earnings, custodial care, medical expenses and care, pension contributions, and lost wages.
Non-economic damages compensate the patient for non-monetary injuries and losses he sustained or is reasonably likely to incur in the future due to his physician's negligence. These include loss of consortium loss of the ability to enjoy life's pleasures, disfigurement, permanent impairment, mental suffering and distress, as well as physical pain and suffering.
