There is a potential for a hospital error at many stages of the patient’s hospital visit.  Hospital malpractice is often the result of a health care provider failing to prevent injury or illness to a patient, as a similarly situated medical professional would have done. 

There are several common types of hospital malpractice which include:

  • Failure to diagnose, or an incorrect diagnosis or a patient's condition
  • The patient suffers an undue injury due to surgical errors
  • Anesthesia complications can occur when the patient is given too much or too little anesthesia or has an allergic reaction
  • Prescription drug errors when the patient does not receive the right medication, or the right dose at the right time with the correct frequency
  • Infection acquired while in hospital

Steps to Take Before Filing a Lawsuit

Each state has a certain time limit to file a medical lawsuit, and generally you must file your case within two years.  You should obtain all of your medical records from the clinics and hospitals that treated your condition. 

You should have an expert, such as a doctor in the same area of medicine review them and give you their opinion. You should file a lawsuit if both the attorney and expert believe that you have a viable case.
