Wrong Implant Given in Cataract Surgery

Cataract surgery is supposed to correct a vision problem that can impact your ability to see and potentially make you blind. However, if you are given the wrong implant- one meant for someone else's cornea or with a different prescription than the one for your eye, then you could end up in an even worse situation. You may be unable to see at all, your eye may react badly and may become infected, and/or you may have to have a new surgery to correct the error. Worse, if the implant led to infection and/or damaged your eye, the problem may not be able to be corrected and you may suffer permanent loss of vision in the affected eye. If this happens, what can you do?

Medical Malpractice

If your doctor botches your cataract surgery and gives you the wrong implant, you likely have a very strong case for medical malpractice. To win a medical malpractice case, you need to prove:

• That your doctor was negligent. Proving negligence in this situation shouldn't be too hard. The standard is whether a reasonable doctor would have done what your doctor did. Since most reasonable doctors wouldn't give a patient the wrong implant, you should have a very good argument that your doctor was negligent.
• That your doctor's negligence caused injury. If your doctor implanted the wrong implant, at the very minimum, you'll be able to prove that you had to suffer another surgery- which your doctor should have to pay for. Any additional damage or injury that directly results from the improper implant should also be paid for by your doctor.
